Every here are not lawyers, you all need to understand what has to be done when a lawsuit is initally filed. These parents are not sueing the estate exacatly, that is how it has to be presented until the company claims that the pilot is clamed as an employee, then the suit against the pilot will be removed, but this is how it has to start. This decision was very hard for the parents. They are still going thru each day in a cloud as if it were all a dream and so are the others who helped care for this beautiful angel. Have a heart and don’t think them bad people because they are not. And they are not going to be pocketing the money for themselves. They have been helping all those envolded in the care of the child by making donations to the hospitals, fire/ambulance departments and others involved in her care. Leave them alone and back off. Put yourself in there shoes before putting them down, they want to make things better for those who need this kind of emergent service.

The last time this child needed to be transported she was very critical and could not tolerate the ambulance ride. The air flight was her only hope. Thus having to go further than winfield would have been more dangerous. This was her life line to help.

well, this case has opened a can of worms. let’s look outside of the box….

    1) it was an emergency flight that took the child to the hospital. the helo was dispatched and sent – even landed. so the pilot was aware of the lines because he to have flown over them to come to the site. questions arise as to the time of the initial flight to the site versus the time he left. power lines in most cases have a ball or light to help w/piloting over and around.

suing the estate of the pilot, is not going to help because he was not flying a private helo. the business will have to take care of it.

your not going to replace a person with millions of dollars. yes, it is an awful situation. life is precious. we live in a society that thinks that every accident someone has to be at-fault and pay out a huge ridiculous amount of money. society wants big brother to keep paying and paying and paying.

Right, this was her life line – Now you bite the hand that feeds you. Do you think these helicopter flights are cheep? Do you think the pilot deserves this? Is this what he gets for helping that kid?

Think about this one folks, if im a lawyer, Im saying “ok its unfortunate the child died, but of course the final disposition should be lowered due to the fact that the child was sickly and would not have lived a long and productive life to begin with”

This is not good for society, this is why they have to cut back on emergency helicopters in a lot of places, its too much of an expense, and this law suit will make things even worse.

the thing about plane/helicopter crashes is that the only guy who knows what really happened, the pilot, is dead. It’s easy to blame the dead guy and maybe he did make a mistake, but stuff happens. Yes it’s a tragic accident for all involved, but suing the pilot’s estate is trying to punish someone for an accident. I know pilots and they always say that the info in the paper/news usually isn’t the way it happened, but only the pilot knows for sure.

It appears to me that the parents are only interested in money. i love how lay people like these parents know whats best for and how best to operate a medical helicopter. it’s like since you know all about this business, why don’t you just run the company?

Absolutely Nancy. What deplorable people would use such an unfortunate thing to profit from.

If memory serves correctly, there was really no reason for the baby to be flown anyway. It seems to me that I heard that the kid had a siezure history. If that is the case, it probably wasnt medically necessary to fly anyway.

Maybe when they are suing everyone under the sun, they can sue the hospital who sent the kid, the doctors that authorized it, and the hospital that accepted it.
