    ur correct, they should have liability insurance. there is a max that should be payed out. the amount they paid to me is excessive amount, especially when the attorneys wind up with a quite a chunk of change. this is why our courts are not very good at giving these awards. the money is split into the favor of the attorney even though the split looks like the other way. the amount that should be paid to the victim never gets there because of attorneys. if i ever get a law degree, i would make it worth the victim hiring me because, i would make sure the get the huge portion gets to the victim. the damages should be weighed to the actual damages not the extreme. this is why lawyers are rich. think about this, when you see class action lawsuits for the millions of dollars, by the time the victims get it, they wind up getting less than the attorneys who fought for the $$$. this is why lawyers like class action. this is where there needs to be a better situation for the victims. here’s the other factor we tend to forget, even if i lost the case, i still get paid as a lawyer, although it might not be much as if i had won. so where’s the solution?

    Wudchuck — very story. Had a client that dropped a huge crane on the freeway completely blocking both ways of travel on not one but two different hwy. Within three days of the accident, a motorist had a class action lawsuit drafted and filed with the Courts seeking compensation for “lost time, wages, etc”. Thank gawd the judge saw it for the trash it was and threw it out w/o leave to amend. Trust me, one day a bogus suit like this will get through and then watch out…
