    The original suit was, apparently, a Dec Relief action likely filed by the
    carrier(s) – I note Hartford and Chubb(Federal) who are well experienced commercial auto carriers.

    Has to be some sort of policy language question.

    No one in their right mind would take a coverage position on a loss such as this without a darn good reason

    The lawsuit is necessary so (I can find the deepest pockets available, no matter if they were involved or not so I can get the most money), said Steve Collier, an attorney for the family of David Betts, one of the players who died.

    Thanks compman-I couldn’t have said it better. I was just passing through Atlanta this past weekend on I-75 and the roads were pretty clear to me. I have it on pretty good authority that the wife of the driver had just turned the bus over to the husband(both killed)and I would suspect that he was still a little sleepy. It’s a shame that people died, but let’s hear it for the attorneys circling the court.

    from the article the lady “filed a lawsuit in September against the university, the company that made the bus, the city of Atlanta and the company that provided the bus and driver for the team”

    Please tell me exactly WHAT responibility the school and maker of the bus had in this accident, that would make them liable in this case?

    If anyone ever traveled on this road they are aware of the stupid exit. The govt created the problem therefore they should be liable. Not the driver or owner…sue sue sue is the by line of the lawyers! Good luck USA in the future…the lawyers are tearing apart the country.

    You’re right. This is the most stupid design for an exit EVER! This was bound to happen. If you don’t live here you don’t know. It’s definitely a masterpiece in senility. The Georgia DOT and state are responsible – not the school, its officials, etc. If that’s the case then school field trips, out of town/state games, etc should be a thing of the past if those that schedule them are subject to liability. The deep pocket party will never end then.

    The “non-involved” defendants should file a counter-claim against the plaintiffs for filing a frivolous suit, causing them to incur un-necessary legal expenses, and wanton and willful negligence in asserting claims without merit. They should demand full reimbursement of costs, and lost expenses of those who had to become involved in playing the plaintiff’s game of “let’s find a deep pocket”. The rules should be that if you take a shot at somebody and miss………you pay the penalty.

    The first time I read the headline I got 5 Target Insurers were killed. What were the insurers of the Target stores doing on a bus?
