    It really chaps me to see these stories repeating themselves all the time. I read an article the other day where someone got an $8M settlement against State Farm because the DA didn\’t build a strong enough case of insurance fraud. So, they get away with the crime, the insurance claim money and $8M to boot? I fear it\’s only going to get worse.

    As a former auto claim adjuster I can tell you that this is just the very tip of the iceberg. In handling claims I was taught that regardless of how bad is looks, if I cannot absulutely prove my case to withhold payment for a claim then I must pay it. This means that way too many questionalble claims are paid than should be paid. Many people are getting away with the money of the honest insuring public.

    However….I cannot place all of the blame on the general public. A large majority of the blame has to be placed on the legal community. It is too easy to place frivolous claims and get away with it. Try to drive on your way to work without seeing at least one personal injury attorney\’s bus bench or billboard. Why not make a claim when they are telling you that you may be hurt and not even know it for years…..and they will not collect a dime until they make that \”bad\” insurance company pay not only the $500 to fix the dent on your bumper, but also the $10,000 of medical bills you may incur when your neck starts hurting sometime in the future.

    Something must change!

    Laz, I feel your pain. I work closley with our claims department and see this occur way too often. And I agree, the trial lawyers are killing the United States.

    The key is to keep the settlement amount low enough that it is cheaper to pay it than to fight it in court.
