Yarmouth, Mass., Health Board Takes No Action Against Site of Drowning

The Board of Health in Yarmouth, Massachusetts, has unanimously voted to take no action against the owner of the hotel where a 9-year-old girl from New York drowned last month.

The victim’s 12-year-old sister almost drowned.

A lawyer for the Bayside Resort’s insurer told the board Monday that blame for the drowning should fall on the inattentive adult relative assigned to watch the children in the pool.

There was no lifeguard on duty on Aug. 20 when the two girls were found unconscious at the bottom of the deep end of the indoor pool, but no lifeguard was required and signs at the pool clearly pointed out that no lifeguard was on duty.

The Cape Cod Times reports that the hotel faced possible sanctions including loss of license.
