Lessons for Employers and Insurers in the Wake of the Sandusky/Penn State Scandal

    In the late 90’s, PSU insisted degree program candidates working in the health field profession during their fieldwork had to purchase insurance from McGuinness and Associates.
    This was for the protection of the student and the University. When a student was accused of a confidentiality violation during fieldwork, and dismissed, the student filed a claim with the insurance for unforeseen damages whereas there was no prior incident remotely similar that escalated to the same level. The claim was refused. Many years later, it became obvious that the true reason behind the violation was the fact that Gerald Sandusky was standing in the photo with the Head Start Agency’s clients.
    McGuiness and Associates were equally negligent, and should still be liable, 16 years later. Will they pay? Never.
