New York Victim Attacked by Dog Can Sue Owner

A woman who was attacked by a dog she was trying to help in Central Park can sue the animal’s owner.

A Manhattan judge on Wednesday ruled that Danielle Gervais had presented enough evidence about the “dangerous propensities” of the German shepherd-Collie mix to go forward with a lawsuit.

Gervais required 30 stiches to her face after the dog, named Rudy, attacked her in July 2009.

Daily News says Ruby’s owner, Meresa Laino, argued that Gervais assumed a risk when she decided to “meddle in a perilous situation” and untangle the dog’s paws from a wire mesh fence.
