A federal judge has dismissed a lawsuit filed by a Milford woman injured during a visit to the Prime Hook National Wildlife Refuge in Delaware.
Jeanne Wright sued the government last year, alleging that she broke her ankle after her foot got tangled up in vines on a wooden bridge in Prime Hook during a visit in 2011.
Wright claimed refuge officials were negligent in allowing the vines to grow into and over the bridge and failing to warn visitors.
The government argued for the case to be dismissed, noting that Delaware’s Recreational Use Act immunizes private landowners from liability against claims of ordinary negligence.
The judge on Friday agreed, ruling that because a private landowner could not be held liable under the circumstances, neither could the government.
