Scottsdale Insurance to Pay $1M to Fired Pennsylvania County Employees

    this is what happens when local elected officials think they can do whatever they wish to do without consulting professionals. most of these people have owned small businesses, deliver mail, work as supervisors in factories, they may mean well or may be mean spirited but in most cases do not understand employment rights and law. the plaintiff’s lawyer says that no tax payers money will be used in the settlement but when the town’s insurance comes up for renewal the policy will probably not be rewed or their will be a very large increase in the premium because of the settlement. after all, the town will be rated on its losses and lack of leadership. believe me, the tax payers are going to be paying for years.

    Wrong! The tax payers wouldn’t pay immediately for the settlement but upon renewal Scottsdale probably will no longer offer the town a liability policy or they and any other carrier offering coverage will significantly increase the premium because it is now a loss on the city’s record and willful irresponsible decisions made by their elected officials. Believe me, the tax payers will pay in the long run. No doubt the elected officials, right or wrong in their opinions as to the cause, are probably made up of small business owners, factory supervisors, church deacons, mail carriers, etc.. Good people for the most but not experts in employment laws. Rather than seeking out advise, or even worse ignoring expert advise, the proceeded in a course of action which was not lawful. Even if they somewhat right how could they tell whuch employees were hired strictly because of patronage and mot merit. This was at best a which hunt that turned badly for the town.

    The tax payers will pay in much higher liability premiums when the policy comes up for renewal. This is a paid claim and will now become a factor in their renewal rate. The biggest factor is their elected officials judgement. How can you tell if an employee was hired on their merit or patronage? What a which hunt? Before embarking on these mass firings didn’t the officials consult with an attorney or a personnel expert? This type of thing happens all to many times when power is given to the wrong type of individuals who think they can do what ever they want to and play “god”.

    This happens frequently when authority falls in the wrong hands. How can you tell if a friend or relative is hired for their merit or patronage? The only way with dealing with employees is by judging them fairly as to their manner they perform their tasks period. Why didn’t these elected officials consult with an attorney or an employment expert before proceeding. Anyone with any common sense would know that a mass firing, except theft, a change in needs or a new method of doing business is creating a real hardship on those families suddenly unemployed. That is why we have laws against such arbitrary measures. When the liability policy renews the policy will be difficult to obtain. after all what insurance company wants to insure a city council who are a liability themselves?
