Where was the loving family of this 33 year old adult when he was having chest pains? Why didn’t he call 911 and go to a real hospital? Absent any prior conditions, the standard of care is an EKG. There must have been a congenital defect to cause death like this. It’s unfortunate the Clinic’s insurer paid anything, although it was a minimal settlement that says something about the lack of merit of the case.

There is nothing in this report to indicate the clinic or the two individuals failed to exercise due care or were negligent. The settlement was due to mediation and will be honored by the insurance company regardless of the merits of the family’s claim. I’m sorry for their loss, but the root cause was not the clinic or their employees.
