Virginia Judge Dismisses $1 Billion Fly Ash Lawsuit

A group of Chesapeake residents plans to refile a $1 billion lawsuit against Dominion Virginia Power after a judge dismissed claims that fly ash used to build a golf course harmed their health and property.

The lawsuit was filed in 2009 on behalf of 453 people. It claims Dominion Virginia Power sent 1.5 million tons of fly ash to the Battlefield Golf Club at Centerville despite a consultant’s conclusion that the ash would eventually pollute drinking water of nearby homes.

Media outlets report that Chesapeake Circuit Court Judge Randall Smith issued an order Wednesday saying there’s insufficient evidence of contamination, injury or damage.

An attorney for the plaintiffs told the court that he plans to refile the case within six months.
