The NJ Supreme Court is an embarassment. Enforce personal responsibility, not allow some loser who negligently allowed himself to get drunk profit from his poor judgment. This is why people lose respect for the legal system.
Obviously, if this suit is successful this would set a horrible precedent. As a business owner how could you protect yourself? Do you require your employees to administer a breathalyzer before every drink is sold? Would you even be allowed to do that? I doubt it…
I realize that employees in a business that serves alcoholic beverages have a responsibility to cut their patrons off when they’re obviously inebriated, but depending on the circumstances, it can be extremely difficult to judge when someone has gotten to that point…
