This happended 10 years ago and the plaintiff is suggesting there’s a need for more discovery? This is absurd. The evidentiary trail deteriorates with time and we’re not talking any sophisticated issues here. I wonder why only the plaintiff, and not his bride went over the edge? This condition is open and obvious and was apparently un-marked. Anybody with an ounce of common sense should have known it wasn’t meant to be walked. I feel bad he’a quad, but what was the duty owed and breached to establish negligence/liability? He should have stayed in their room and practiced the “horizontal mambo” instead of walking on the edge of cliffs.

well, first of all, trails can be made from following one person to another and it’s not the ability of the city to cover those tracks. by now, how many more trails have been made? would this not be like the NY Central Park and i can walk any direction i want, but if i fall of the sidewalk i can sue? the other thing, if on a honeymoon walk, where was my bride? was she not hanging onto me while walking? where was her hand or arm? why did she not fall over? also, where was he looking while walking? afterall, he’s responsible to look where he walks, it’d be like walking off a diving board into the water or walking into the middle of the street… after 10 yrs, how many trails will there be?

I think there’s more to this story. I think the bride suddenly realized she married a flabby girly man so she gave him a shove when they were near the edge. Then, she told him if he ever said anything, she’d disconnect his respirator.

I first find it hard to believe that he wouldn’t take responsibility for his actions; took to the wrong path and fell!
This is the same guy that would sue the National Weather Service for having his party rained on! Wraaaaaah!
