A federal judge in Vermont has dismissed a lawsuit filed by a motorcyclist injured at a police roadblock set up to prevent him from fleeing.
Thirty-year-old Paul Bourn claimed Bennington police created a danger by not waiting to apprehend him at home even though they knew his identity and address.
Bourn claimed he hit the road block on a motorcycle while traveling 100 mph and now suffers a number of lingering medical problems.
On Monday, U.S. District Court Judge J. Garvan Murtha dismissed Bourn’s suit against the Bennington Police department and a number of officers.
The Bennington Banner says Murtha ruled state law didn’t allow Bourn to sue the police department.
Bourn represented himself. He’s currently in jail.
