Paralyzed Man Sues Virginia Ski Resort for $25M

A man paralyzed from the waist down in a snow-tubing accident in Virginia is suing the parent companies of Massanutten Resort for more than $25 million.

John Carwile of Hampton was injured after his head hit the wall at the end of a tubing run in January 2009 at the Rockingham County ski resort.

Carwile’s lawyer, Patrick Regan, filed the lawsuit in March in Charlottesville Circuit Court, seeking $25 million in compensatory damages and $350,000 in punitive damages — the maximum allowed by Virginia law. It alleges that Massanutten was negligent in setting up and operating the snow-tube runs.

Massanutten’s director of business operations, Kenny Hess, said he couldn’t comment on pending litigation.
