you are exactly right. what happened to being a responsible driver? if it was a bad ice storm, do you think they want to endanger their drivers? afterall, you could have slid into them yourself. then, who would you sue? them for being their and trying to fix the light? or would be correct and indentifing yourself as to blame for losing control?
simply put, nature does not control your car for driving. you enter an intersection basically at a control crash site. even w/the lights working you might not have been able to stop and got into an accident.
Also named in the suit was the manufacturer of the calcium chloride that evidently did not melt the ice that caused the intersection to become slippery. The car maker was also included in the suit when it was discovered that the little light on the guy’s rear view mirror that warns of ice, was not flashing ice, thereby giving him a false sense of security about entering the intersection.

I found this report hard to believe, until I re-read it and discovered the motorist was from MA – It all makes sens now.
