This is an awful situation and I feel very badly for the Lamberts, but I don’t see how the hospital is responsible. You mean to tell me Mrs Lambert didn’t know her sister was mentally ill and under psychiatric care? Once again, it boils down to the lack of personal responsibility in this country. People are always looking for someone else to blame for their mistakes and then want compensated! Ridiculous!

the problem is did that sister allow her sister to babysit the children or how did the children come into her care? if she sent her kids to babysitting, she should have had a clue of her siblings mind. the hospital is not required to tell siblings of any condition, unless there is a signed waiver. sounds to me like they want something in return for an unexpected ending. truly i am sorry for their loss, but i don’t think they will get anything.
The woman killed had a LONG history of serious mental illness. The mother/sister should not have given the kids to her no matter what family/personal feelings were. Very sad, but this was preventable by responsible parenting!

If the hospital is forced to make a large settlement all this does is increase the operating costs of the hospital and raise their med mal rates.
This kind of problem should be part of health care reform but isn’t.
I am always surprised by the creativity of US citizens to find liability potential – nobody in Europe – at least not in the part where I live – would dream about sueing a hospital in such case. Cross my fingers we never get in such nightmare scenario system.
The problem, Europe, is that we have too damn many lawyers here in the U.S. I doubt if the parents considered suing the hospital until some ambulance-chaser got in touch with them and talked them into it.
That may well be true, but there is still a decision made by the parents that such claim is worth it based on a belief that the claim is possibly relevant. Surely we don’t have ambulance chasers (thank God) but even if we would have we do not believe that a (remote) third party such as the hospital is to be blamed.

Maybe the husband should file a “friendly” suit against his wife who had to know that her sister was sick. As usual, will the money replace the kids??

Whether the Lamberts are awarded something or not, the cost to defend these crappy cases is a big issue!
