I have unfortunately been in a position where an injured worker had a choice between workers’ compensation and a potentially more lucrative civil suit.
The injured worker in my case, choose the civil suit (her family actually since this woman is brain dead) and that choice turned out to be the wrong one.
Take the comp, then sue. If you win the civil case, the compensation carrier is due to be repaid 100% of it monies and expenses before the injured worker sees a dime.
Keep in mind that just because you win a judgement, does not mean you will get a penny of it. The woman who owned the chimp owns a tow truck business, and let me tell you by experience these businesses do not have a lot worth to them. Also in the intervening years, who knows what actions the owner took to hide/shield her assets.
Take the comp claim, you will get your medical paid now and going forward, you will get a weekly stipend, you will get something.
Sue and chances are you will get nothing, but your lawyer could win the jack pot. Of course all the lawyer loses is some time you loose any hope of support.

If Nash was asked by her employer to help get the chimp inside then I think it can be determined she was acting as an employee.
