    Providing a deep pocket so the surivors can get rich quick is stupid. The only culpable party here is the piece of human garbage who raped and butchered this woman. The government cannot be expected to be able to control every whack job that walks the streets. There’s no negligence here. Rehabilitation efforts don’t guarantee results. By the way, the fact that the victim ignored the pleas of her friends to leave the bar with them earlier should be considered. There’s heavy comparative negligence on the victim for allowing herself to get so drunk she couldn’t avoid a dangerous situation. I’m tired of people getting themselves injured or killed then trying to blame someone else for their poor judgment.

    The Governmental agency cannot get immunity because they botched the case??? Is that a ruling or a show of bias on the judge regarding whether the parole agency is liable? I thought that Govt agencies are granted immunity for their ordinary negligence, and for actions within their propretary duties. They would not need immunity if they did not botch the case… would they? if this ruling stands, then would the police dept be liable if they failed to properly investigate a crime and the same perp commits another crime? if so, might as well open the flood gates?

    Why stop with Congress? I think we should sue the entire 52% of the electorate that voted an incompetent Cummucrat into office for destroying the Consitution and placing the U.S. on a path of complete destruction

    I agree the ruling by this federal court judge seems to defeat the point of governmental immunity, and I would hope that the government will successfully appeal the ruling. As has been pointed out by many, though, the article lacks all the facts considered by the court.

    The endless whining on this and other posts at this site about the current administration’s influence on “everything” is tedious. Even a cursory investigation of this judge shows that this judge has a prosecutor’s background, was appointed New York City Criminal Court Judge by Republican Mayor Rudolph Giuliani, Judge of the New York Court of Claims by Republican Governor George Pataki, and nominated to the Federal bench by George W. Bush in 2003. Not a “Cummucrat” in the bunch. Quit making every issue political. It’s tiring and more than a little paranoid.
