    Sex & gender are one in the same. The judge ruled correctly and distinguished between sex/gender and sexual orientation, which are two different things. The discrimination was due to the biological male not acting in a way others thought a biological male should act. That is gender discrimination. It is conceivable if he was a masculine acting gay person, the discrimination would not have occurred and, therefore, he is owed his day in court.

    Sex means male or female.

    Gender means masuline or feminine.

    This “guy’s” sex was male, his gender feminine. Does this mean that he can’t lose, or can’t win, his lawsuit?

    I’m confused. So, apparently, were his coworkers.

    Just because people make fun of someone doesn’t translate to discrimination. People have the right to feel the way they do. You can’t force anybody to accept something or someone who appears “strange” to them. That’s called equal rights. The world never was and never will be perfect. If this “guy” can’t take the heat he should get out of the kitchen. We all have issues to deal with. If this workplace isn’t supportive, maybe he should find another place to work that is.

    Everyone deserves a harassment-free workplace. People have the right to feel the way they do but they do NOT have the right to ACT on those feelings if it constitutes harassment or discrimination on the job. Every HR professional knows that. No one’s demanding perfection but society would still be in the Dark Ages if the bullys were never confronyted. That is the basis for the anti-slavery movement, the women’s movement, the civil rights movement, etc. If everyone just walked away, nothing would improve.
