Drunk is drunk is drunk. Assigning a point system is like picking fly s h i t out of pepper. Impound his car, throw him in general population for 30-days, and if he get’s another DUI, make it a year in the slammer.

I’ll betcha they just throw the test out…
If he argues the test was inaccurate, the police will still say he was drunk through observation etc.
you don’t need the test to be convicted of DUI
