It would be interesting to find out when the policy effective dates were that Mr. Wilcox assumed he had coverage. Did the Agent testify? On its’ face, it would seem that it would have neen an easy job for the prosecutor to prove fraud when a person calls his agent and request coverage, hours after an accident occurred. How closely did Wilcox control his company?

How did the insurance company know about the accident? If someone is trying to reinstate their coverage that is not necessarily fraud. The insurance card shows the effective date of the policy. When someone shows that card to police it is assumed that the coverage is current. The card only is there becasue it is a requirement that it is carried in the vehicle. The insurance on the 26ft truck I drive runs out in May. If the company cancels the insurance I have no way of knowing it is cancelled.
