    Smith said –GEICO tried to cancel Marston’s policy for nonpayment sometime around the time of the crash, she had paid for coverage through that date and GEICO’s effort to cancel her policy was invalid. GEICO disputes that it was insuring Marston when the crash happened.

    Just read the gosh darn cancellation notice.

    I can just picture the paper trail on this mess, good grief.

    Did GEICO send legal written notice of intent to cancel for non pay? What was the effective date of the cancellation notice? Can’t Marsten prove that she remitted payment on the policy in adequate time prior to the scheduled cancellation date?? If GEICO received that money then GEICO should have issued a notice of rescission of the cancellation. GEICO failed to or chose not to do so because there was a claim now rearing its ugly head??? Another reason to have a good broker in your corner.

    My son had GEICO and replaced at renewal and notified GEICO at expiration. They kept billing him for an additional week of coverage for some crazy reason. I don’t think they are very good at keeping track of dates.

    Can’t they get the gecko to flip a coin, coverage or no coverage???

    1) $400k for loss of companionship. they are already an older couple, he’s 85 and she is 76. this should be for a couple of lower age. granted all life is precious and priceless, but this is excessive.

    2)$100k for economic loss? what?! he’s retired and she is probably as well. both are probably drawing retirement from social security. where’s the loss here? they probably don’t even make that much money in 1 yr much less, retirement. again, a farce!

    3) medical bils, this is probably more accurate and should include the cost of the funeral.

    trouble: how much were her limits of liability? does he carry UIM cvg? because UM coverage would not suffice.

    What are you basing your judgment on? Do you just feel that the two amounts awarded are excessive and a farce? Or is there something more than your emotions?

    1) the amount awarded for companionship — that is too much.

    2) farce, because what economic loss? both were retired! neither was working.

    so who truly is the money for? the lawyer to line his pockets?!

    A quick PSA to wudchuck…my mom is 76 and makes well over 120K still working as a teacher. She is in incredible shape. My dad is 80 and sometimes teaches as a subsitute teacher when he is not at the gym 5, yes 5, days a week. He plays handball 3 days a week and walks several miles daily. I am 36 and would defintately say, my father is in better shape than I am.

    Back to the issue at hand……..

    you are right, wudchuck. the dollars just aren’t there; the award is excessive based on the age, etc.

    i can understand if they are both working. that makes sense. we just don’t know when they put this information up as to if they are working or not. i am glad you mom is a teacher, my wife teaches as well. thank her! good to know that your dad still feels the need to keep in shape.

    I think the real issue here is why they haven’t figured our whether or not the Geico policy was in force at the time of the accident.
