Why should docs get an enormous subsidy by having the legislature and the insurance department conspire to prevent them from having to pay the full cost of insurance like the rest of us sheep? Force them to pay adequate rates and then cap non-economic damages at $250K — nothing else will work — if they do try something else, it will be Dinallo’s unfortunate legacy (i.e., he’ll be just as guilty of putting a band-aid on the wound as the last couple of administrations).

Try taking $50k out of your pay over the next 2 years and see how you do. What is a reasonable rate as you suggest? 25% of your gross pay on top of premiums and all other operating expenses. I don’t think so.

Whoa JB, hold on there. miller didn’t put any numbers in his post – he said “reasonable”. I think we can all agree that med-mal premiums are too high. They need to be made reasonable so doctors can afford to practice. Part of getting to that will be capping non-economic damages so insurers can start projecting risk better.
