The way the nation handles medical malpractice cases is insane. We need some states to start pioneering better ways of handling these situations. I haven’t read the bills myself, but if the article represents them correctly they sound good to me.
Medical Insurance Claim Reform Act
(State Bill,1,1976)had most of the same provisions outlined above – but also an absolute cap on non-economic damges of 250K, 90 days notice of intent to sue and required a Certificate of Merit BEFORE suit and periodic payment of damages at the option of the defendent – has worked pretty darn good for 30 years
