    Ok, I can understand the installer and the building owner, but the manufacturer and the retailer? cmon, that is overkill and the lawyer should be sanctioned. Plus 30 mil is ridiculous as well. Maybe 5mil would be ok.

    Agree that the retailer and the manufacturer are totally out of the picture on this one – this is what is wrong with this country!

    As for the 5mm sum, that’s a tough call. Appears there are forr victems here – so wouldn’t the award be based on the earning power of the husband (depending on his age and station at the time of death), along with loss of consortium for the wife, loss of companionship for the daughter, as well as the second daughters loss of her father and sister? Not sure but it sounds like both mother and daughter were also in the room which could have also included medical issues there as well.

    This one is going to be interesting to follow. At last check (several months ago) I believe there were 13 states with mandatory CO detectors in residential dwellings, all commercial habitational exposures including hotels – I’ll have to check to see where MD stands on this issue today as there may be more here than first reported. (now you know why I’m not in claims…)

    I agree with you, compman, primarily on the retailer if they did not change the product. Manufacturer…may be bad design, wasn’t clear. Feel bad for her loss, but 5mil is a bit much too.

    You have got to be kidding me with your comments. For one, there is no price high enough for a loss of a child, let alone a husband too. Furthermore, if you know anything about CO poisoning, the mother and child will have side effects for the rest of their lives. (headaches, muscle aches, memory loss, etc.) I do think the manufacture is responsible, I have read every article on it, way back to 2006… this was the second water heater, the same model that caused injury to people, one in 2005, in the same hotel. So, hope she gets all she ask for.
