    I’ve been to Laconia in 1972 and there were riots…I didn’t hear of any law suits going on then but now you are right sue, sue, sue…Can’t win for losing.

    Try reading the articles that lead up to this decision – The women were walking along side a busy road and struck from behind by an impaired motorcycle driver – They were trying to sue based on advertising that included sponsorship by alcohol distributors – and the lack of “supervision” by police and the city to provide safe pedestrian passage during this event which draws 400,000 people – No – it isn’t always right to “sue” but there is more to this story than the IJ will ever publish

    I was just going to ask what led up to the suit. Do you know where I can go to read the whole story? If this was an impaired driver, then the driver should be responsible for the accident (responsibility is one of my biggest pet peeves). The idea of including the alcohol sponsors in the suit for this event is ridiculous at best. (IE: “The sign made me do it”). A good example of
    deep pockets. Then, a lack of supervision of over 400,000 people by the City? No way. Why were they walking along side a busy road, anyway? Common sense dictates
    safety in this case.

    Let me see if I have this right. Two pedestrians, in the midst of busy traffic, are walking with their backs to traffic. A little lack of personal responsibility here perhaps? Also, now we hold mere advertisers and event sponsors to be liable? This is not (yet anyway) a nanny state. Just how much “supervision” is necessary to keep people aware of their safety. Ok, sue the motorcyclist, but the event organizers abd sponsers? Pure lunacy.

    I have yet to attend bike week but I have a great idea of what goes on there. People have to use common sense – true – I have not read the entire article but those two women already received a settlement (from the biker, I assume). People can’t go around blaming anyone and anything for terrible things that happen. PERSONAL RESPONSIBILITY & common sense…duh!!!!

    The only way to curb this type of litigation abuse is for the innocent defendants to counter-sue the plaintiffs for damages including negative publicity, mental anguish, and defense costs. When there’s a consequence to “shot gunning” every defendant you can find by naming them in a suit maybe the plaintiff bar will think twice before causing people to spend money for no reason.

    What may be a better preventative measure is to adopt some of the English system, in which the loser of a lawsuit pays the cost of litigation (defense atty cost and court costs). Some may argue that it prevents the small guy from being heard in court, but isn’t it unfair for the defendant to have to make a choice between paying off the unwarranted plaintiff, instead of paying big $$$ to defend yourself.

    None of this suprises me. for some reason, Gettysburg, PA has now become a bike-week mecca, in addition to the already established tourist trade in the civil war. I am amazed at how many middle aged people seem to think that riding a big ol’ harley is like riding a bike but when they have an accident, it has to be someone else’s fault. the first phone call is to an attorney. The courts ought to throw out all suits for negligence to make the point that this is a serious machine, and riding is serious business, not just the fun-in-the-sun, wind-in-the-hair poker runs that they contemplate. These are just accidents waiting to happen and I avoid all motorcyclists so that I don’t get caught up in it by “accident”.
