Why is the proximate cause always avoided? At least two incidents I’m aware of involved the decedent causing their own demise. One was a kid who decided to get out of his seatbelt and ended up falling into the water and drowned. The one with the 21 year old PARK WORKER AND OPERATOR OF THE RIDE involved her jumping in at the last minute and not fastening the safety belt. Too bad…..but this is an amusement park and safety belts are on rides to keep bodies inside. You can’t idiot proof rides. The only way to avoid these things is to require and adult over the age of 30 accompany everyone under the age of 21 on every ride in the park.
