I remember my Dad going into surgery. We would mark in big bold letters “Not this one” or “The other side” to make sure the doctor knew which side was to be operated on. That was, in fact part of pre-op. The hospital provided the marker and gave us plenty of time to get him all colored in.
It sounds like this guy has a solid case. Odd for a story in IJ.

I don’t understand how they can make that mistake? Did he have hammer toes on both feet? If not, did the doctor think it had magically disappeared by operation time?
the guy filed for an administrative remedy which was denied, prior to filing suit. Sounds like he tried to get this resolved without going to court, but the government is not quick to admit its failures….

The article I read regarding this story had some other informaiton on this case. I heard that the doctor actually amputated the wrong foot and after discovering his mistake had to amputate the “correct” foot.
When explaining this to the patient he said “I have some good news and some bad news” The bad news is that, unfortunately, I amputated the wrong foot, and after realizing my mistake, I had to amputate your other foot—the good news is the guy in the next room wants to buy your slippers”.
