N.J. Court: Out-of-Stater Can Be Sued for Libel for Web Postings

    This action represents a government trying to control its sworn enemy: an information source that it can’t control. This has nothing to do with “protecting the public” and everything to do with a lame attempt to control the internet. Fortunately, the internet and other modern means of communication have grown too big for the government to tackle. The only solutions that government has to any problems are: pass laws; put some people in jail; or kill some people. Thank God this will have no effect on the internet.

    Actually this involves a rather narrow issue,ie, personal jurisdiction and whether the plaintiffs could sue in NJ or should they have sued where the defendants live. These people in NJ clearly could have started this lawsuit in California alleging a violation of California law on libel. I think reading an attempt by government to suppress the internet is overreaching. Many governments are trying to control and censor what is on-line but that is not the case here.
