    First – not to discount the fact that the party was in fact injured, and suffered multiple fractures – can anyone explain what kind of economic damages a 74 year old suffers that warrants 1.175 million? Considering her age, state of health at the time – how is this possible? Did she also sue the cigarrette company because she was jonzin for a but at the time of the accident:

    “Sara, who lived in Jackson at the time, was crossing Route 528, attempting to reach a gasoline station to buy cigarettes, police had said at the time. Singer had been driving home from his legislative office, according to authorities.”

    Her injuries included a fractured arm, leg, ankles and a concussion, said Hobbie. Sara has since moved to New Hampshire. (in a nursing home requiring care 24/7/365?)

    Can anyone see a crosswalk?

    From other articles looks like the Senator has his own fair share of problems…

    In December 2005, Singer pleaded guilty in municipal court to failing to yield to a
    pedestrian at an unmarked crosswalk and careless driving. He was ordered to pay fines and court costs.

    Singer, 59, has been involved in two other serious motor-vehicle accidents since 1997. A 49-year-old Lakewood man died following an accident in June 2001. Police said the man’s vehicle pulled out in front of Singer and witnesses said Singer had no chance to avoid the collision.

    On Sept. 17, 1997, Singer’s SUV struck two pedestrians in Lakewood. Police said the two men stepped into Singer’s path from between two parked cars and admitted they had been drinking heavily the night of the incident.

    Just curious as to how the settlement was calculated and reached..

    I’m with you guys. I live near Jackson and it’s very rural. I doubt there are any crosswalks in the area. The plaintiff attorneys comments are comical that “nothing’s more important than her health”. How healthy can a 74 year old woman be to begin with. We shouldn’t be surprised that the carriers caved in on this. Target defendant with deep pockets and a high percentage of retirees in the Lakewood/Jackson area make for adverse juries. She’ll be lucky to net half the settlement amount and after taxes, the amount will be around $375K. Hopefully her heirs will appreciate the money.

    I thought the US was plaintiffs paradise, however if you think you got it bad, here in the UK you can get US$2m+ for slipping on flower petals outside a sellers stall, do thesew people not have eyes.

    There are two major flaws with society. First, personal responsibility has been eroded to the point where the negligent person is never responsible for their own stupidity or clumsiness. Second, the legal system allows frivolous suits to be filed instead of throwing them out. It’s absurd to think that anyone bears the burden of keeping a walkway 100% free of any debris 100% of the time. Pedestrians have a duty to watch where they’re going. Unless you’re blind, you should be able to see something on the ground in front of you. If you choose to walk through it and fall, tough luck.

    Just this morning I was walking from the bus stop to my building and stopped at a busy interstection in lower Manhattan waiting for the “walk” sign. Along comes some jerk with headphones, reading a book, and doesn’t stop. He was almost flattened by a truck that had to slam on it’s brakes and blow the horn. The jackass pedestrian simply looked at the driver and continued to cross, still reading the book. I’m sure if he would have been struck he would have sued. Quite frankly, he deserved to be struck.
