Great ruling by the NJ Supreme Court. I hope Rhode Island follows suit. This is a perfect example of frivilous lawsuits wasting the time and money of the courts.
I guess venue shopping will continue until all 50 states and all the federal circuit courts are exhausted. I am surprised that someone felt the need to litigate this further. But like so many other political issues, this won’t ever be completely settled because some people just can’t accept “NO”
This is far from a wast of time and money.So many children suffer irreversable damage from lead pait. Someone needs to be held accountable.If this matter was taken more seriously then we would see the posivtive effects of our “time and money”…
Well it certainly shouldn’t be the Paint Makers, Suppliers or Distributors nor should it be the gov’t. Why not put the responsibility on the parents of the children? Oh that’s right, this is america where parents have no responsibility for their children and it is up to everyone else to care for the children except for the parents that made them. Sorry, my mistake as I thought people might just take responsibility for their own children. How about this, watch your children and don’t let them eat paint chips. It’s sort of like when I stopped my child from eating yellow snow… it’s called responsibility.
How about the landlords and building owners who are too cheap to scrape and repaint the walls. As the article noted, lead paint has been banned since the ’70s. Thirty years is enough time for someone to repaint the damn walls. Also, the parents should be responsible. If there is peeling paint, do something about it instead of watching your kids eat the stuff!
