Anchor, Not Ship Owner, Found At Fault in Delaware River Spill

    If the above mentioned river-huggers would have spent their time cleaning up the river instead of complaining about its use, this accident never would have happened. The ship was navigating under known conditions with appropriate care. In fact, it would not surprise me to see an activist group plant the anchor to cause the damage in order to bring more publicity to their cause.

    What I want to know is will the shipping company get it\’s $124 Million back. Since the Coast Guard has concluded it not being their fault, why shouldn\’t they be compensated for what they spent in clean-up? If so, wehre would the money come from? I suggest the Delaware Riverkeeper Network – since they didn\’t keep their precious river clean.

    It wouldn\’t surprise me to hear that A.) The duty to clean the spill is without regard to fault, so the ship\’s owner is out the money, B.) By offering to, and actually paying, the cost of clean-up, the ship\’s owner waived any right to recover the money except from the actual responsible party, or C.) All of the above.
