Accidents happen all the time. In today\’s American society, with lawyers\’ influence, even freak accidents demand big payoffs. I am waiting for my mother to die of anything other than a heart attack (even then!) so I can sue someone.
Jerry, That\’s pretty cynical. Wonder if you\’d feel the same way if that was your mother or grandmother. It\’s like saying if you only had a parachute when the top car on the ferris wheel gave way and plummeted to the ground killing all aboard.
spare us..I guess it doesn\’t matter if the operators may have been negligent by overloading the boat in search of the almighty buck…but don\’t worry the poor, poor, poor insurance company\’s pocket books are relatively safe under NY\’s wrongful death law… they can only recover for pecuniary loss.. and I don\’t know of any 89 year olds who are big wage earners…I guess thats why we pay for insurance(otherwise liability insurance serves no useful purpose) so that if we negligently injure another human being we can compensate them or the family for the loss…

If only she had a life jacket she could have survived and gone on to have a long and productive life.
