Md. Cop on the Wrong Side of the Law; Convicted of Insurance Fraud

November 10, 2005

Maryland Attorney General J. Joseph Curran, Jr., announced the conviction of a seven year veteran of the Prince George’s County Police Department for insurance fraud.

Jermaine Ayala, 30, of Lanham, received an 18 month suspended sentence and was placed on three years of supervised probation for submitting a false claim to his automobile insurance company by Judge Michael Whalen of the Prince George’s County Circuit Court. The conviction followed an investigation by the Insurance Fraud Division of the Maryland Insurance Administration, the Office of the Attorney General and the Maryland State Police.

According to the statement of facts submitted by the Assistant Attorney General in support of Ayala’s plea of guilty, Ayala submitted a false lost wage form, fictitious pay stubs and made oral misrepresentations in support of a personal injury protection (PIP) claim after he was involved in an automobile accident.

The false claim for lost wages pertained to his part time job as a security guard at a CVS pharmacy. Ayala reportedly misrepresented his hourly rate, hours worked and how he was paid in the form. The pay stubs were generated by Ayala to support the false information in the lost wage form.

Once confronted with discrepancies uncovered by the Special Investigations Unit of State Farm Insurance Company, Ayala withdrew his claim and was paid nothing. State Farm then referred their findings to the Maryland Insurance Administration, Insurance Fraud Division.
