Who will appoint this new officer? The (Democrtat-controled) Senate? If so then it seems to me that is a Separation of Powers issue, which maybe should involve some judicial review.

Some sage folk with an understanding of Economics have suggested this is the beginning of the end for Medical Mutual. The doctors need to consider what they would do if MedMu goes belly up. Who will insure their Prior Acts then? The people of the State of Maryland?
