Counsel should work routinely with their client companies’ SIU’s also… The SIUs work closely with the State and other law enforcement agencies and that is a big part of the reason for their existence.

My name is Ryan Leacock and on July 27,2005 a curbside commercial vehicle ran into me. There was a person who came \”out of the blue\” and offered to take me to a clinic after the police came and made their report. My back was really starting to tighten up. While he was taking me to the clinic, he told me that he had a place where I could get the car repaired. He told me that as long as I keep going to the clinic for treatment, it could only boost my case, in the event that I seek a law firm. He even told me that the clinic had an attorney that was comparable to Jacoby & Myers (a prestigious firm). One more thing that was stated was that it was a \”no brainer\”, who was at fault, due to the impact points of the accident.
I bit and even retained this firm. I noticed that I was not receiving the necessary treatment I needed, so I went to another clinic. I noticed that I could never get in contact with my attorney and found that this firm was not well known at all (as a matter of fact, they withdrew from my case two weeks before I went for my EUO.
The icing on the cake was this: the other insurance company stated that they were not at all liable and went on to say that they have a witness who states that I was on my cell phone and I ran into the commercial vehicle (according to the police report, there were no witnesses).
Number one, I never had my cell phone with me (my cell phone records can substantiate this, along with the 911 audio files pertaining to the accident), as a matter of fact, the first call was made by me on another person\’s cell phone because I didn\’t have mines.
I took pictures of my vehicle the next day and my insurance did the same shortly thereafter.They stated that I was not liable.
Since the two could not agree, it went to inter-company arbitration. They could not make a definite ruling but stated that there was a witness for the other side who stated what happened. Due to this, the deductible cannot be collected.
What happens if I can prove that this \”WITNESS\” of theirs is lying? I have suffered 10 months of pain (for example, I have 2 herniated discs in my lumbar region alone) and next week have to go for a discogram to determine the next phase of treatment.
It is extremely frustrating when an innocent person is caught up in this. Any advice at this point? I filed a complaint with the NYS Insurance Department: they stated that they were not at fault and are going through inter-company arbitration. The insurance states that I obtain a lawyer and pursue. I am ALMOST at my wits end. It is difficult enough managing my pain. Any words of wisdom? Take care and God Bless.
