Physicians who elect not to carry a professional physicians liaiblity policy do not transfer their risk to the hospital. The hospital’s policy or Institutional Liablity policy does not normally cover physicians. These are entirely two seperate coverage agreements.
Suits follow the coverage. If the doc does not have the pocket (insurance or otherwise) he is less likely to be carried through trial. Anecdotally, you seem to see more negligent credentialing, vicarious liability and nursing lawsuits against the hospitals. I doubt the idea of “going bare” is the answer to the current situation but there is real world risk transfer effect that hospitals ignore at their own risk (no pun intended).
