    The sad part is the penalty is no deterrent to stop insurance fraud. To attempt to steal one million dollars should be a criminal offense, not civil. The only way we are going to reduce fraud is by stiffer penalties!

    I agree wholeheartedly with Rick – if we are going to put a dent in insurance fraud, criminal convictions get more attention than a civil action.

    Unfortunately, the probation charge is the criminal conviction. The perpetrators should serve actual jail time, be called upon to pay higher criminal fines/penalties, and also be ordered to pay restitution to the insurance carrier (think about the investigative costs incurred by the carrier to determine that this is a fraud case). The Insurance dept. and insurance industry has to do more in regards to publicizing the cost/affect of fraud on the insuring public, as well as the criminal and civil consequences of fraud. Of course, we will need the legislature and the courts to impose harsher penalties.

    Oh, i forgot to add that I suspect that at least one of the perpetrators of the fraud has committed similar crime(s) in the past. I also suspect that the fines imposed by the courts, are amounts that these perpetrators can pull out of their “spare change jar” at any time.

    You’re all correct, much stiffer fines- amounts that leave the guilty with $100., OK, leave them with $200. Then they must be sent away- no time off for good behavior- ten years minimum. Let all the white collar crooks and greedy minds think about sitting in a jail for ten years.
    Now don’t you all think the same should apply to our friends in corporate America? Leave the b——- penniless and throw away the key for ten years.

    I agree with everyone. This is definately a felony charge and should be delt with in a harsher way. These gents should do some hard time and be used to set examples of the theft and pre meditated manner in which they affect all insureds by acting in such a malicious manner. The rich get away with these types of issues time and time again. They can use the monies stolen to protect themselves and still, we the general public must continue to pay the consiquences. How sad our judicial system is in this country.

    Restitution should also be made to the poor Insurance Agency for Firemen’s Fund – I’ll bet they lost a contingency – and maybe even their appointment – while all the investigations and legal were pending!

    Ken has the right idea. Insurance companies should lobby all state legislators to make their investigative costs, including overhead, an integral element of the penalty for the crime. I can’t see even the bitterst industry foe objecting to that. It would also give insurers an inducemenet to keep an active investigation unit in place. You’s actually be surprised how few undewriters- Fireman’s Fund a notable exception – marginalize the fraud issue.

    (Is this a scam)After fire at home which I put out-was given a number to call for restoration company.only idems burnt were stove,microwave light floor damage.restore came in & first thing with large sack, empty all food in pantry-tryed to get roast just bought. I ask this question why are you getting the food-said you cant eat this-has soot on it (most never opened)question-where is the adjuster-we dont need one, they trust us-call insurance co.(need an adjuster to come here)still no adjuster.wiped on frigerator,said this wont come off-I took rag & wiped it off.Thats ok we will get you a new one-1/1/2 years old-(we dont want a new one)ask for markus clayton sofa-(to take home to daddy)tried to get bed. Stoped them.Threw contents of frig out & loaded in pick up.Hard wood floors & rug were not damaged untill they came.(call adjuster again)said all is ok.cut up den rug threw out-unhooked two bed room of carpet-rolled up, put in van-threw out blinds, cutains that could be cleaned. Had to drive forty miles to see adjuster-said all ok-never came to look.Asking questions again.restore company quit-took all paint,wall paper left a huge mess.9call adjuster) get some one else or do it your self.Had to buy more paint-wall paper & fid some people to help.Found they charged insurance co. double & triple for frig-(their price 1,600(our price 750)microwave(800-our price 475)Ordered enought wall paper for three houses. (triple price)(call adjuster again)restore adready paid 4,800 to wash dishes & paint half of house.Called home office-show them what they charged for work they didnt do-(marked off around 6,000.Isurance paid them $10,000 more(FOR WHAT) –Wwere trying to save insurance co. money but they went right along with them. Restore co.said it would take ($41,000)to fix house-was ok with insurance co.STILL no adjuster.After 40 years with alfa they let this go on & a year an one half later they refuse to renew our insurance.Have called every one in state to get help-no help.No one made fire report-cant get any insurance at all.Policy went from $600-to $3,00 a year. In my opnion, this company is comdeming every thing they can & takeing it some where & selling it.I feel we could have got any thing we wanted new justing by asking for it.We tried to be honest & fair with insurance co but they didnt want it.Tell me why a insurance co would let this go on unless there are more people involved in the company? We know ther are people that will lie to get all they can but we were not that way. THANKS A LOT ALFA FOR STICKING IT TO HONEST PEOPLE. (GOD IS WATCHING & HE KNOWS WHAT ALL OF YOU DID.
