Pa. Dept. Releases Monthly Enforcement Actions

Pennsylvania Commissioner Diane Koken has released enforcement actions and market conduct examinations taken in March against insurance producers and companies licensed to conduct business in the Commonwealth. Enforcement actions are taken after an investigation reveals violations of Pennsylvania statutes or regulations.

If a formal charge is filed against the individual or company, a hearing is held before the Insurance commissioner. Enforcement actions conclude with the issuance of a consent order, a settlement agreement, or an order and adjudication.

Below is a brief summary of actions taken. More detailed information on each action can be found on the Department’s Web site at www.insurance.state.pa.us.

*International Water Safety Foundation, London, England, Water Safety Services, Quebec, Canada, and North American Marine General Insurance Company, Ltd. – Order to Cease and Desist, prohibited from transacting the business of insurance in Pennsylvania for at least 10 years, and a $200,000 civil penalty;

*Republic of Panama – Order to Cease and Desist, prohibited from
transacting the business of insurance in Pennsylvania for at least 10
years, and a $200,000 civil penalty;

*John H. Gilliam Agency, Inc., Bala Cynwyd, Pa. – Five-year license supervision and $2,000 penalty;

*Jennifer Carrozza, Pittsburgh, Pa. – Five-year, conditional consent to continue the business of insurance subject to supervision by the Department;

*Stephen J. Snoe, Pittsburgh, Pa. – Five-year, conditional consent to continue in the business of insurance subject to supervision by the Department;

*Clarence J. Hall, III, a/k/a Joseph Hall, San Antonio, Texas and Marina Del Ray, Calif; Harbour Entertainment & Sports Insurance, a/k/a Harbour Sports & Entertainment Insurance, Harbour Special Events, Harbour Insurance Management, and Harbour Protective Insurance Service, San Antonio, Texas, New York, N.Y., Los Angeles, Calif. – Order to Cease and Desist and fines totaling over $1.6 million;

*Michael F. DeBello, Fairview, Pa. – Order to Cease and Desist and
five-year future license supervision;

*American Equity Investment Life Insurance Company, Des Moines, Iowa – Order to Cease and Desist and $1,000 penalty;

*Paul E. Goldstine, Greensburg, Pa. – Misappropriation of premium in excess of $500,000, license revocation and ordered to pay full
restitution;

*Michael Segal, Chicago, Ill. – Licenses revocation;

*Shelby Casualty Insurance Company, Birmingham, Ala. – Monetary fine of $60,000.

*American Independent Insurance Company, Conshohocken, Pa. – Monetary fine of $70,000.

*AMEX Assurance Company, DePere, Wis. – Monetary fine of $10,000.
